Sri Lanka rejects US court summons
Sri Lanka has rejected a US court summons served on President Mahinda Rajapaksa over a USD 30 million damages suit against him.The summons, first delivered to ‘Temple Trees’ but not accepted there, was later received by the Ministry of Justice, which rejected it.
“It was based on an unfounded allegation. We have no obligation to respond to that as a sovereign state,” Justice Ministry Secretary Suhada Gamlath told the state-owned ‘Lakhanda’ radio.
He said Sri Lanka had stated in writing the legal position on the issue to the US court.
“We have informed the District Court of the Southern District of Columbia of our legal position,” Gamlath was quoted as saying by the Sunday Times.
He said the Sri Lankan statute — the Mutual Assistance in Civil and Commercial Matters Act No 39 of 2000 — had laid down that the country need not heed such summons, “if we consider that the execution of the request will be prejudicial to the sovereignty of Sri Lanka.”
Gamlath argued that Lankan President enjoyed legal immunity as the head of state and no court could summon him.
Kasipillai Manoharan, a Tamil, had filed a complaint in the District court of Columbia claiming USD 30 million over the alleged killing of his son Raghiar Manoharan.
Gamlath said the plaint was the work of the Tamil lobby in the US backing the defeated LTTE and the motive was to create tensions in Sri Lanka.
President Rajapaksa is expected to visit New York in September this year for the United Nations General Assembly sessions.

We should send USA, Britain and other imperial West countries a clear message that SL is not a country to be pushed over easily, to be their pawn in their game of neo-imperialism and conquest of the world.
We do not bow to silly court cases in the West brought by stupid diaspora LTTE activists hiding in imperial West. Isn’t it high time that GoSL requests the freezing of LTTE assets in the West, though they may be banked under pseudo front LTTE organisations? KP is an LTTE terrorist rogue who should not be held in a safe house with all the creature comforts. He is pretending to divuldge information to the GoSL. What he does is giving a few tit-bits to keep the GoSL happy while having a laugh at us, waiting for the day he will be freed by UNP. Isn’t it high time this high ranking LTTE terrorist is brought to justice and made to swing in Galle Face Green?
USA does not have any rights to send summon to our President. It is better to send a summon to their own President who has been killing thousands of People in Iraq, Libiya, Afghanistan and many other arab countries.

If KP is an LTT terrorist rogue, how would you classify Hon Karuna and CM Pilliyaan?

Your question is valid. Karuna especially has been a great help in the final assaults on VP/LTTE bastions. He gave valuable information. The army and the Defence Secretary has acknowledged it.
Initially, as a young man, Karuna was also inspired by the pro-eelam talks and brainwashing by the extremist politicians and was misled. Like JVP militancy in the South who led so many youths to their deaths by anarchist, radical views, Karuna was misled in the North by VP’s talk of a freedom struggle for their own ‘homeland’. But as he matured, with so much innocent blood on his hands due to genocide of Sinhalese and Muslims, he resented the blood-lust of VP and rebelled against his leader. By such questioning the views of his leader he invited a death sentence on himself. POillayan joined with him to oppose VP openly. They eventually fled to SL army side for their safety.
Karuna was able to provide SL army with intelligence of immense value to help defeat VL/LTTE for good. His support helped SL army to defeat LTTE decisively withibn 3 years with minimumn loss of lives and destruction of property. Had Karuna and Pillayan continued to fight with VP against SL army the outcome of the wart may have even been different. Out of recognition of his service to the country and for giving up terrorism, President Rajapaksa granted him and Pillayan amnesty. As a Buddhist, this is the right course of action.
KP, on the other hand, has never repented for being an LTTE terrorist. He still glorifies LTTE and fight for eelam. He was captured and brought here while in hiding in Malaysia. He has done very little to disclose fully the assets of LTTE held abroad. He is playing mind games with his captors. He is a devious fellow who should now be brought to justice, as he has not delivered the information and support to seize LTTE asstes abroad. If found guilty he should hang for his crimes.
